Acceptance of Terms
Welcome to Qmarketing AI platform designed to improve customer interaction and reduce operational costs. These terms have been prepared by Technical Friend to ensure a clear and fair user experience. Before using our services, please read these terms carefully as using them means your agreement to all the terms and conditions below. Definitions: Platform: Refers to the "Qmarketing" application and all its related services. User: Any individual or entity that uses "Qmarketing" services. Content: Any data, texts, images, videos, or information exchanged through the platform. Subscriptions: Any fees you pay for paid services on the platform. First: Terms of Use - Definition of Terms and Conditions Terms and conditions refer to the rules and regulations that govern the use of the Qmarketing platform, ensuring safe and fair use of available services. - User Definition User/users refers to any individual who creates an account on the Qmarketing platform to benefit from available services or provide services through it. - Agreement to Terms and Conditions By using the Qmarketing platform, you agree to all the terms contained in this agreement, and these terms constitute a legally binding agreement between you and the platform. If any new features or tools are added to the services provided, they will also be subject to the terms of use. - Amendments to Terms and Conditions The Qmarketing platform reserves the right to modify the terms of use or any part thereof at any time. The modified version will be published on the platform and becomes effective one week after the date of publication. Your continued use of the platform after publishing the amendments constitutes your agreement to the updated terms and your commitment to apply them. Second: Registration Terms 2-1 Eligibility The user must be 18 years old or have legal consent to use the platform. The platform is not allowed to be used for any illegal purposes or in violation of local and international regulations. 2-2 Registration and Account Management The user is committed to providing accurate and correct information when registering and benefiting from the platform's services. The user is responsible for keeping login data confidential and not sharing it with any other party. The Qmarketing platform reserves the right to suspend or cancel the account in case of violation of terms or misuse. 2-3 User Obligations The user is prohibited from performing any of the following actions: Causing unjustified pressure on the platform or its infrastructure, which may affect its performance or stability. Publishing or uploading any defamatory, offensive, abusive, racist, immoral, or illegal content in any form. Attempting unauthorized access to the platform or granting others permission to use the account, or impersonating another person. Taking any action that may harm the intellectual property rights of the Qmarketing platform or any third party. Uploading or sharing any files or programs protected by intellectual property laws without obtaining prior permission. 2-4 Actions in Case of Violation In case the user violates any of the above-mentioned terms, the Qmarketing platform has the right to take the following actions without prior notice: Remove any violating content or requests. Suspend, restrict, or stop the account partially or completely. Take necessary legal actions, including reporting to internet service providers or relevant authorities if necessary. Third: General Provisions Account Suspension: The Qmarketing platform reserves the right to suspend the user's account at any time when violating terms and conditions. Information Sharing: The platform has the right to provide relevant authorities with user information when laws are violated or when there is a need to file an official report. Data Retention: The platform retains archived data according to laws and does not bear responsibility for storing archived copies after the end of the relationship with the user. If requested, a cost is imposed according to Technical Friend's tariff policy. Information Protection: We are committed to applying the highest standards of information security, and payment operations are managed by a certified third party to ensure security. Information Management: The user can access and modify their data at any time, taking into account that restricting its use may affect the services provided. Service Requests: The user has the right to choose services, view offers, and know the implementation period, according to the terms and conditions agreement. Compliance with Terms: The user's violation of any clause authorizes the platform to suspend the account immediately and take legal action. Confidentiality and Privacy: The platform does not request any sensitive data outside what is officially mentioned, and the responsibility for protecting information lies with the service provider. Fourth: Payment Services Advance Payment: The user must pay through available means before implementing the service. Financial Fraud: Using incorrect or stolen payment methods is prohibited, and the user bears full responsibility. Currency and Fees: Payment operations are conducted in Saudi Riyal, and the user bears any transfer fees or additional costs. Service Cancellation: The amount can be refunded before starting service implementation, with applicable refund fees deducted. Cancellation Request: It is done through official communication channels, and ending the consultation is not considered a cancellation request. WhatsApp Conversations Pricing: Responsibility Service Provider Responsibility: The service provider alone bears any damages resulting from his negligence, and Qmarketing does not bear any obligations towards the user. User Obligations: The user is responsible for any violation of terms or misuse of the platform. Account Protection: The user bears responsibility for the security of their account and must report to Qmarketing immediately any unauthorized use. Official Payment: Payment must be made through approved means on the platform, and direct payment to service providers is prohibited. Data and Documents: The user is committed to providing correct data, and the service provider maintains its confidentiality, while the platform does not bear any misuse of it. Service Disruption: Sixth: Legal Notifications: Communications from the Qmarketing platform to registered official addresses or notifications through the application are considered legally effective notifications. Seventh: Litigation and Dispute Resolution: This agreement is subject to the laws of the Kingdom of Saudi Arabia, and the relevant authorities are competent to resolve any dispute arising from it. Technical Friend has the right to sue violating parties in their place of residence before the relevant authorities. Eighth: Intellectual Property Rights: All intellectual property rights of the platform, including the logo, software codes, and designs, are owned by "Qmarketing". The user does not have the right to copy, resell, or use the platform's content for commercial purposes without official permission. Ninth: Service and Price Modifications: The Qmarketing platform notifies the user of any price modifications 30 days in advance. The platform reserves the right to modify or stop services partially or completely, with or without notice. The platform does not bear any responsibility towards the user or any third party for any change in prices or suspension or stopping of the service. Tenth: Service Subscription Cancellation: The user can request to cancel their account by contacting technical support, and this results in: Stopping services and losing the account permanently. No refund of any fees when violating terms of use. Any remaining balance is due immediately upon termination with suspension of related services. All data is deleted after cancellation without commitment to storage. Service is stopped after 26 days of delay with the possibility of reactivation later. Qmarketing reserves the right to modify or stop services at any time without notice. Eleventh: Refund of Paid Amounts: The customer does not have the right to request refund and compensation together. Establishment and activation fees are non-refundable, and any refund request due to failure to achieve sales is rejected. The refund period is calculated from the payment date, not from the platform receipt date. Twelfth: User and Visitor Information: When requesting Qmarketing platform services, we may request your banking data, identity, and commercial register to ensure legal compliance and fraud prevention. We collect your basic data to provide the service, communicate with you, and transfer amounts to service providers. The user allows the platform to access the camera and photo library to upload required documents. By using the platform, you agree to share your geographical location through the maps service. We analyze the usage and interaction mechanism to improve services and ensure quality. Order and conversation data within the platform is collected to develop performance and service. Thirteenth: Cookies and Tracking Technologies: We assign a cookie to each device that connects to the Qmarketing platform, and it is stored on your device. We use cookies to identify your device, provide a customized experience, and display relevant advertisements. The platform relies on tracking technologies to analyze performance and improve services. We use data to develop services, detect errors, and communicate with you effectively. Fourteenth: Sharing Information with Third Parties: We share your information with third parties to improve services or meet legal requirements. We may share information with judicial or government authorities as needed. We use information to investigate illegal activities or protect individuals. In case of merging the platform with another entity, information may be transferred with notice of that. We may use your information for marketing or to share offers from other companies. Fifteenth: Terms of Use for WhatsApp and Facebook through the Qmarketing Platform: Agreement to Terms: The customer agrees to the terms and conditions and Meta policies, and the Qmarketing platform's right to stop activities that violate guidelines, with the freedom to choose to work under Meta's umbrella or through a Qmarketing platform account. Accurate Information During Verification: Correct information must be provided during WhatsApp verification, and manipulation or representation of unauthorized business activity is prohibited, otherwise the account will be suspended. Account Suspension or Cancellation: In case of account suspension or cancellation from Meta, the customer does not have the right to refund the amount paid to the Qmarketing platform. Documentation Fees: Documentation fees are paid only for submitting the request and are not refunded if documentation is rejected. In case of rejection, the request is resubmitted for free. Sixteenth: WhatsApp Business Terms of Use: Notice: Requirements are globally unified from WhatsApp and apply to all companies that use WhatsApp Business, and future updates or additions may occur from the company. First: Activation Time Frame: Facebook Business Account Manager (FBAM) Documentation: Document collection requires 3 working days, then the account is subject to review which may take more than 30 days. WhatsApp Approval of Display Data: Approval takes 5 to 10 working days, and rejection may require additional time. Second: WhatsApp Business API Restrictions: Agreement to Terms: Must agree to WhatsApp's unified service terms before use. Message Deletion: Messages cannot be deleted after sending. Message Replies: Cannot specify a message to reply to individually. Daily Status: Does not support adding daily status. Groups: Cannot add WhatsApp Business number to groups. Starting Conversation: Must wait 24 hours after the last customer message to start conversation. Template Review: Message template review takes 24 hours. Voice Messages: Can receive voice messages from customers, but recording is only done through the Qmarketing platform application. Third: Transfer WhatsApp Business Account to Another Service Provider: Account transfers between service providers are done easily within a week. Fourth: Mechanism for Returning Number to Regular WhatsApp Business Account without Qmarketing: Complete account deletion from the Qmarketing platform. Cancel the number and return it to regular WhatsApp Business.
